Welcome to the Asian Community Development Center (hereinafter referred to as “ACDC”, “us”, “our”, or “we”). 

We are committed to protecting the privacy and security of the personal information of our community members, donors, clients, and website visitors.  This policy describes how we collect, use, and share information when you engage with us, including via our website (www.acdcco.org), programs, events, and communications. 

2. Information We Collect

We only collect information that is adequate, relevant, and limited to what is necessary for our stated purposes.

A. Information You Provide Voluntarily

  • Contact Information: Name, email address, postal address, and phone number. For example: when registering on the ACDC website, expressing an interest in obtaining information about us or our products and services, or otherwise contacting us.

  • Financial Information: Donation amounts and history. Sensitive payment details (like credit card numbers and the associated security codes) are processed by third-party processors and not stored directly by us.

  • Volunteer Data: Application details and resumes.

B. Information Collected Automatically

  • Usage Data: IP address, browser type, operating system, device identifiers, and pages visited.

  • Cookies and Tracking: We use cookies, similar technologies, and other technical data to analyze site traffic, understand user preferences, and improve user experience. You can manage your cookie preferences through your browser settings.

3. How We Use Your Information

We process your information, which is received via our website, only for the following express, specific, and legitimate business purposes:

  • To facilitate account creation and logon processes.

  • To send administrative information to you for business purposes, legal reasons, and/or possibly for contractual obligations.

  • To fulfill and manage your orders.

  • To post testimonials with your consent.

  • To deliver targeted advertising and analytics to you.

  • To request feedback.

4. Sensitive Data and Children’s Privacy

A. Sensitive Data

  1. We may collect certain categories of information that are defined as "Sensitive Data" under applicable state privacy laws. This may include information related to your racial or ethnic origin, religious beliefs, health-related information relevant to the course, your participation in the course, or other information volunteered by you during the course enrollment and participation process.

    Your participation in providing Sensitive Data is strictly voluntary.

  2. We collect and process your Sensitive Data for the specific purpose of data analysis only - This includes aggregated and statistical data derived from Sensitive Data (e.g., race, ethnicity, or disability status) used to analyze program effectiveness, identify service gaps, and fulfill requirements for grant applications and reporting to institutional funders.

  3. By enrolling in our courses or participating in related programs, you provide your affirmative consent for us to collect and process your Sensitive Data for the purposes explicitly listed above. You have the right to withhold or withdraw this consent at any time.

  4. We maintain your Sensitive Data in the strictest confidence. We do not and will not sell, share, rent, or trade your Sensitive Data with any third-party entities for marketing, advertising, or cross-context behavioral advertising purposes.

    Any disclosure of this data is strictly limited to:

    • Our internal staff and volunteers who have a direct need-to-know to administer the courses or prepare de-identified grant reports.

    • Legal or regulatory bodies when required by law, court order, or governmental request.

    • Institutional funders, but only when the data is aggregated, de-identified, and fully anonymized so that it cannot reasonably be linked back to you as an individual.

  5. We employ safeguards (including encryption, access controls, and regular employee training) designed to protect your Sensitive Data from loss, misuse, or unauthorized access. We retain Sensitive Data only for the period necessary to fulfill the purposes outlined above and as required by legal or grant-related retention obligations.

B. Children’s Privacy – We do not knowingly or intentionally solicit data from or market to children under 13 years of age. If we learn that we have unintentionally collected personal information from a child under age 13, we will comply with the Children’s Online Privacy Protection Act of 1998 (COPPA) and delete that information as quickly as possible. 5. Processing and Sharing Your Information

We do not sell, rent, trade, share, or process your personal information to third parties for monetary compensation or otherwise. We may only disclose your data in the following limited circumstances:

A. We share necessary data with trusted third-party vendors (for example, email platforms, hosting, data storage) who perform functions on our behalf. These vendors are required to protect your information and are contractually prohibited from using it for any purpose other than providing services to us.

B. Legal Obligations: We are legally required to disclose your information to comply with applicable law, governmental requests, a judicial proceeding, court order, legal process, or to protect the rights, property, or safety of ACDC or our community.

C. Donor Privacy – We do not share, sell, or exchange our donor list with other non-profit or commercial organizations.

6. Security of Your Information

We use administrative, technical, and physical security measures to help protect your personal information. While we have taken reasonable steps to secure the personal information you provide to us, please be aware that despite our efforts, no security measures are perfect or impenetrable, and no method of data transmission can be guaranteed against any interception or other types of misuse.

We retain your personal data only for as long as necessary to fulfill the purposes for which it was collected, to meet our legal obligations, or as required by our internal data retention schedules.

7. Your Privacy Rights

As residents of the US, you have specific rights concerning your personal information:

  • Opt-out of the processing of your personal data for targeted purposes. 

  • Confirm whether we are processing your personal data.

  • Request access to your personal data and obtain a copy of your personal data.

  • Request rectification in or erasure of your personal data.

  • Restrict the processing of your personal information.

  • Data portability.

8. How to Exercise Your Rights

You may exercise your rights by:

  1. Submitting a Request: Emailing us at info@acdcco.org.

  2. Appeal: If we deny your request, you may appeal our decision by responding to the denial email within 30 days. We will respond to your appeal within 45 days.

9. Changes to This Privacy Policy

We may update this privacy policy from time to time, without advance notice to you, in order to reflect, for example, changes to our practices or for other operational, legal, or regulatory reasons.
